      Frühzeitig reagieren & Abmahnung zuvorkommen

      Das größte Kosten- und Haftungsrisiko besteht darin, dass Copytrack den Fall an einen Anwalt weitergibt und dieser den Unterlassungsanspruch mit einer Abmahnung geltend macht. Denn wer das Urheberrecht oder ein anderes geschütztes Recht widerrechtlich verletzt, kann nach § 97 Absatz 1 UrhG auf Unterlassung in Anspruch genommen werden. Ist die dann ausgesprochene Foto Abmahnung berechtigt, d.h. fehlte in der Vergangenheit tatsächlich eine Lizenz, kommen hohe Rechtsanwaltsgebühren dazu. Das kann man durch eine vorbeugende Reaktion verhindern.

      Abmahnrisiko ist Ihre Chance

      Solange Sie also „nur“ Copytrack anschreibt, haben Sie die große Chance, einer teuren Abmahnung eines Anwaltes vorzukommen. In solchen Fällen ist es daher ausnahmsweise ratsam, vorbeugend eine eigene Unterlassungserklärung an den Fotografen zu übersenden.

        Nicht jeder Fotograf kann sein Honorar nach der MFM-Tabelle berechnen

        Zunächst muss es sich bei dem Fotografen um einen Berufsfotografen handeln. Alternativ muss es sich um ein hochwertiges Foto handeln, dass an die Qualität eines Berufsfotografen heranreicht. Zudem darf die Fotoaufnahme nicht im rein privaten Kontext genutzt worden sein.

        Der Fotograf muss beweisen, dass er solche Verkaufspreise erzielte

        Zudem ist nicht per se auf die MFM-Tabelle abzustellen. Vielmehr sind nach der Rechtsprechung des BGH bei der Festsetzung einer angemessenen Lizenzgebühr solche branchenüblichen Vergütungssätze und Tarife nur dann als Maßstab heranzuziehen, wenn sich in dem entsprechenden Zeitraum eine solche Übung des Fotografen herausgebildet hat (BGH, Urt. v. 06.10.2005, I ZR 266/02). Mithin ist zu prüfen, ob der Fotograf tatsächliche solche Entgelte erzielt hat. Maßgebend ist also primär die eigene Lizenzierungspraxis des Fotografen, wenn eine solche existierte.

        Schadenersatz begrenzt auf vernünftigen Entgelte

        Abgemahnte haben daher – im Haftungsfalle – folglich „nur“ dasjenige zu zahlen, was auch tatsächlich als Nutzungsentgelt im Rahmen einer regelmäßigen Übung erzielt worden wäre. So ist ein nach der Lizenzanalogie rückwirkend zu berechnender Schadenersatz danach festzulegen, was vernünftige Parteien bei Abschluss eines Lizenzvertrages in Kenntnis der wahren Rechtslage und der Umstände des konkreten Einzelfalles als angemessene Lizenzgebühr vereinbart hätten (OLG Hamm, Urteil vom 13.02.2014, Az. 22 U 98/13; OLG Köln, Urteil vom 01.03.2013, Az. 6 U 168/12; OLG Düsseldorf, Urt. v. 11.11.1997, 20 U 31/97; Dreier/Schulze, UrhG, 4. Aufl., § 97).

        MFM Arbeitskreis

        Die MFM (= Mittelstandsgemeinschaft Foto-Marketing) ist ein Arbeitskreis des Bundesverbandes professioneller Bildanbieter e.V. (BVPA). Dieser Arbeitskreis ermittelt jährlich die aktuellen Honorare für Fotonutzungen in Deutschland und gibt diese unter dem Titel Bildhonorare als Broschüre heraus (MFM Tabelle).
