Unterlassungsanspruch

Sind die teuren Abmahngebühren gerechtfertigt?

Viele Fragen sich, ob nicht jedenfalls die Rechtsanwaltsgebühren von Rasch Rechtsanwälte nach einem Streitwert von 1.000 Euro gedeckelt berechnet werden, so dass sich eine Forderung von circa 100 bis 150 Euro ergibt (für die Gebühren des Abmahners).

Deckelung ist beim Filesharing unbillig

Eine solche Begrenzung der Kosten nach einem Gegenstandswert von 1.000 Euro gemäß § 97a Absatz 3 Satz 2 UrhG hält vor Gericht nicht stand. Das Gesetz sieht bereits eine Ausnahme vor, wonach der Gegenstandswert von 1.000 Euro nicht maßgeblich sein soll, wenn dieser Wert “nach den besonderen Umständen des Einzelfalles unbillig ist”.

Besonderes Gefährdungsptenzial

Diese Unbilligkeit ist anzunehmen, da es sich aufgrund des Uploads um einen schwerwiegenden Urheberrechtsverstoß handelt, bei dem ein erhebliches wirtschaftliches Interesse des Musikproduzenten an der Rechtsverfolgung besteht (siehe LG Stuttgart, Urt. v. 21.04.2015, 17 O 329/14). Bei der öffentlichen Zugänglichmachung im Rahmen einer anonymen Online-Tauschbörse existiert ein besonderes Gefährdungspotenzial. Immanent einer derartigen Verletzungshandlung ist eben nicht nur die öffentliche Zugänglichmachung, § 19 a UrhG, sondern auch die unkontrollierbare, grenzüberschreitende Vervielfältigung der Musik durch den Upload, § 16 UrhG (vgl. hierzu AG München, Urt. v. 20.09.2013, 158 C 18032/13). Die Unterlassungserklärung führt zu einem Unterlassungsvertrag mit dem Rechteinhaber und ist immer mit einem Strafversprechen (Geldstrafe) ausgestattet – siehe § 97a UrhG.
