Wie man der Getty Images Abmahnung entnehmen kann, wurde festgestellt, dass Sie ein Bild von einem Fotografen nutzen. Da der Urheber einer Fotoaufnahme jedoch exklusiv bestimmt, ob und wie sein Lichtbild genutzt werden darf, müssen Sie die Nutzungsbedingungen unbedingt einhalten. In vielen Fällen ist ein kleiner Geldbetrag für die Nutzung aufzubringen. Ferner ist die Quelle & der Fotograf zu benennen.

Riskante Erklärung

Was Sie sich immer vor Augen führen müssen, geben Sie eine Unterlassungserklärung ab, stellt dies ein Angebot auf Abschluss eines Vertrages dar. Dieses Angebot führt zu einem Unterlassungsvertrag mit dem Fotografen oder Rechteinhaber wie Getty Images. Der Vertrag ist immer mit einem Strafversprechen zu versehen – siehe § 97a UrhG. Das Strafversprechen sieht eine hohe Geldstrafe für den Fall der Wiederholung vor. Waldorf Frommer setzt die Vertragsstrafe regelmäßig bei 5.000 Euro an. Unterschreiben Sie auch keine Muster von Waldorf Frommer. Diese sind zu Ihrem Nachteil.

Es nützt nichts, wenn Sie das Argument bringen, dass Foto konnte jeder im Internet finden und daher auch beliebig benutzen. Die Nutzung von fremden Fotos muss durch den Urheber gestattet worden sein. Das mit Abstand größte Kosten- und Haftungsrisiko besteht darin, dass Getty Images den Verstoß zur Bearbeitung an Waldorf Frommer weitergibt. In einem solchen Fall droht die Versendung einer teuren Getty Images Abmahnung. Mit dieser Abmahnung wird dann der Unterlassungsanspruch geltend macht. Denn wer das Urheberrecht eines Fotografen verletzt, kann nach § 97 Absatz 1 UrhG auf Unterlassung in Anspruch genommen werden. Wäre die Getty Images Abmahnung dem Grunde nach berechtigt, d.h. fehlt eine Nutzungserlaubnis, löst diese Abmahnung zusätzlich hohe Rechtsanwaltsgebühren aus.

Abmahnrisiko ist Ihre Chance

Solange Sie „nur“ eine Lizenzanfrage erhalten haben, bietet sich die Chance, einer teuren Getty Images Abmahnung vorzukommen. In dieser Situtation ist es wichtig, schnell zu reagieren. Ausnahmsweise wird man vorbeugend eine eigene Unterlassungserklärung an den Fotografen abgeben. Denn diese lässt die Berechtigung der Abmahnung Foto entfallen, so dass jedenfalls die teuren Gebühren für die Getty Images Abmahnung selbst entfallen.

Eine sofortige Löschung des Fotos rettet nicht

Wenn Sie „lediglich“ das Foto offline stellen und aus Ihrer Webseite löschen, ist der Unterlassungsanspruch noch nicht erfüllt. Der Fotograf kann weiterhin eine Abmahnung aussprechen. Nur die Abgabe einer Unterlassungserklärung dient als Erfüllung. Die Löschung der Fotos lässt die Urheberrechtsverletzung also gerade nicht entfallen. Die Vorgehensweise ist daher rechtlich unsicher.

Das Foto darf nicht mehr online sein

Sollte es nochmal zu einem Verstoß kommen, ist die Wahrscheinlichkeit hoch, dass man dann eine Vertragsstrafe von Ihnen für Getty Images fordert. Diese Vertragsstrafen werden im Bereich von 5.000 Euro und höher angesetzt. Zudem erwächst der Unterlassungsanspruch erneut, wenn Sie den Verstoß nochmal begehen. Das Lichtbild muss daher komplett verschwinden, insbesondere aus den Suchmaschinen (Cache). Hierbei helfen wir Ihnen gerne.
