Lebenslanger Unterlassungsvertrag

Beachten Sie Folgendes: Geben Sie nach einer wettbewerbsrechtlichen Abmahnung eine strafbewehrte Unterlassungserklärung ab, werden Sie im Ergebnis einen Unterlassungsvertrag mit dem Abmahner eingehen. Dieser ist über viele Jahre gültig und immer mit einem Strafversprechen versehen.

Folgeverstöße sind sehr teuer

Sollte es in Zukunft nochmal zu einem identischen oder kerngleichen Verstoß kommen, haben Sie gegen das von Ihnen erklärte Versprechen aus der Unterlassungserklärung verstoßen. Das hat als „Wiederholungsverstoß“ ernsthafte Konsequenzen. Als Folge wird man eine zweite Abmahnung aussprechen können, da der Anspruch auf Unterlassung neu auflebt. Zudem wird man von Ihnen die für den Wiederholungsfall versprochene Geldstrafe fordern. Solche Geldstrafen werden im Bereich von 1.000 – 10.000 Euro angesetzt. Es besteht daher ständig die Gefahr, dass die Kostenfalle aus der strafbewehrten Unterlassung zuschnappt.

Erst sämtliche Verstöße beseitigen

Völlig riskant ist es daher, dass Abgemahnte lediglich die strafbewehrte Unterlassung erklären, jedoch die Verstöße vorher nicht vollständig beseitigen. Ein eindeutiger Fall für eine teure Vertragsstrafe.

Alle eigenen Internetseiten prüfen

So kann sich z.B. eine fehlerhafte Widerrufsbelehrung sowohl auf der eigenen Internetseite als auch auf eBay befinden. Auch das jeweilige Impressum ist auf seine Rechtmäßigkeit hin zu prüfen. Ansonsten kann es innerhalb kürzester Zeit passieren, dass eine Vertragsstrafe von mehreren tausend Euro zu zahlen ist. Vor allem dann, wenn das wettbewerbswidrige Verhalten nicht vollständig abgestellt worden ist. Daher reicht es nicht aus, einfach die Unterlassung zu versprechen. Es sind auch alle weiteren Internetseiten bzw. Verkaufsplattformen zu prüfen, auf denen der Abgemahnte aktiv ist.
