Gibt es eine Berechtigung hierzu?

BigData – Unternehmen & die sozialen Medien sehen persönliche Daten als werthaltiges Gut an. Solche Daten und die daraus erstellten Profile eines Verbrauchers sind gerade im Wettbewerb gewinnbringende Faktoren. Daher kann man Verstöße gegen das aktuelle Datenschutzrecht durchaus als wettbewerbswidrig ansehen.
Viele Interessierte fragen sich daher, ob man Konkurrenten  wegen der „neuen“ DSGVO abmahnen kann. Sind mangelhafte Datenschutzbestimmungen, die sich auf einer Website befinden, demnach abmahnfähig?
Aktuell ist diese Frage nicht sicher zu beantworten! Es gibt bislang keine gerichtliche Entscheidung zur DSGVO mit Bezug auf eine Abmahnung gegenüber Mitbewerbern. Jedenfalls nicht nach dem Stichtag vom 25.05.2018 (Umsetzungsfrist). Daher ist es unverständlich oder der Zeit sehr voraus, dass ein sogenannter Abmahnverteidiger aus Baden – Württemberg, die nachstehende Antwort preisgibt:
Der Kollege meint tatsächlich, dass es die herrschende Ansicht in der Rechtsprechung und Literatur in der Bundesrepublik Deutschland sei, dass es bei Verstößen gegen die DSGVO bereits an einer Berechtigung zur Abmahnung fehlt. Dem ist nicht ganz so. Die herrschende Rechtsprechung und Literatur zur DSGVO gibt es derzeit noch nicht. Allein aus diesen Gründen ist diese Aussage korrekturbedürftig.
Dazu hat es in der Vergangenheit diverse Entscheidungen einiger Gerichte gegeben, die gerade bei Verstößen gegen den Datenschutz eine Abmahnung als berechtigt angesehen haben. So ist allein das OLG Stuttgart beim Bundesdatenschutzgesetz zu dem Ergebnis gekommen, dass bestimmte datenschutzrechtliche Verstöße sehr wohl abgemahnt werden können. Dieses Urteil sollte der Kollege, der auch noch Abmahnungen wegen der DSGVO verteidigt, eigentlich kennen. Jedenfalls liegt das OLG Stuttgart in seinem Wirkungskreis.
